response to the tragic earthquake on January 12, 2010,
the United States designated Haiti for Temporary Protected
Status. This designation means that Haitian nationals (and
aliens having no nationality who last habitually resided
in Haiti) who have continuously resided in the United States
since January 12,2010, and who remain in continual physical
presence in the United States from the effective date of
the notice of designation, may apply for TPS within the180-day
registration period that begins on January
21, 2010. These nationals also may apply
for employment authorization documents and
for permission to depart from and return to

are a national of a country designated for TPS,
or a person without nationality who last habitually

- You file during the open registration or
re-registration period, or you meet the
requirements for late initial registration regardless

or re-registration period;
- You have been continuously physically present in the United States since the most recent designation date of your country;
- You have been a continuous resident in the United States since the date specified for your country;
- You have not been convicted of any felony or two or more misdemeanors in the United States;
- You are not a persecutor, or otherwise subject to one of the bars to asylum;
- You are not subject to one of the criminal or security related grounds of inadmissibility for which a waiver is not available; and
- You have met all the requirements for TPS registration or re-registration as specified for your country.
