Workers’ Compensation

Monetary Benefits

If you are injured on the job, besides medical benefits, our Orlando, Florida workers’ compensation lawyers may be able to assist you with obtaining the correct amount of monetary benefits known as indemnity benefits. Under Florida law, your indemnity benefits are based upon your average pre injury wages also known as the Average Weekly Wage or AWW. Our Orlando workers’ compensation attorneys often find the insurance company incorrectly calculated our client’s AWW and therefore owe hundreds, if not thousands, of dollars to our client’s for underpaid indemnity benefits.

Section 440.15 Florida Statute Indemnity Benefits

Temporary Total Disability Benefits

Temporary Total Disability Benefits are also known as TTD benefits. You are entitled to biweekly TTD benefits during the period of time your workman compensation doctor says you are unable to work. These benefits are paid at 66 2/3% of your AWW.

Temporary Partial Disability Benefits

Temporary Partial Disability Benefits are also known as TPD benefits. You may be entitled to biweekly TPD benefits during the period of time your workman’s compensation doctor says you are able to return to work in a light duty or restricted capacity. Calculating your TPD benefits can be complex and should be handled by an experienced Orlando, Florida workman compensation attorney.

Permanent Impairment Benefits

At some point in time, your workers’ compensation doctor will determine that you reached Maximum Medical Improvement or MMI. MMI is the point in time you doctor believes you are as good as you will get. It does not mean that you will not need future treatment or that you are 100% better. Instead, the workers’ compensation doctor does not believe that additional treatment will provide any further lasting improvement of your medical condition. When you reach MMI, your workman’s compensation doctor will assign a number known as your Permanent Impairment Rating. The larger the number, the more weekly benefits you should receive. Our Orlando, Florida workers’ compensation lawyers often successfully prove the date of MMI and the permanent impairment rating are incorrect. When this occurs, you may be entitled to additional monetary benefits plus a 20% penalty and interest.

Permanent Total Disability Benefits

Permanent Total Disability Benefits are also referred to as PTD benefits. If your doctor and experts determine that you are not capable of returning to work in a sedentary capacity after reaching MMI, you may be entitled to PTD benefits. Depending upon your date of accident, you may receive biweekly payments of PTD benefits for the rest of your life. Insurance companies often times wrongfully deny claims for PTD benefits because paying them is expensive. Our Orlando Florida workers’ compensation attorneys successfully obtained PTD benefits for numerous clients throughout Orlando, Apopka, Winter Park, Winter Garden, Ocoee, Altamonte, Daytona, Deland, Deltona, Cocoa Beach, Melbourne, Lakeland, Tampa, St. Petersburg, Clearwater, and Fort Meyers.
